This End User License Agreement and Terms of Service (“Agreement”) is a binding legal contract between you (“User,” “you”) and Blue Circuit LLC d/b/a jobRoutr (“Blue Circuit,” “jobRoutr,” “we,” “us,” or “our”) governing your access to and use of the jobRoutr web application, mobile applications, APIs, and related services (collectively, the “Services”). By creating an account, installing, or using the Services, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree, do not use or access the Services.
By accessing or using the Services, you agree to this Agreement. If you are using the Services on behalf of a business or entity, you represent that you have authority to bind that entity to this Agreement.
The Services are not intended for use by individuals under 13 years old.
Blue Circuit LLC d/b/a jobRoutr grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services solely for your internal business operations related to customer management, scheduling, and route service tracking.
Use of jobRoutr mobile apps is also subject to the terms of the Apple App Store and Google Play Store.
You must provide accurate and complete information when creating your account. You are solely responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify jobRoutr immediately of any unauthorized use or security breach. jobRoutr is not liable for loss or damage resulting from failure to safeguard your account.
You retain full ownership of all data you upload or enter into the Services, including customer, job, and service information (“Your Data”). You grant jobRoutr a limited, worldwide, royalty-free license to host, store, process, and display Your Data solely for the purpose of providing and improving the Services.
We may compile anonymous, aggregated usage data for analytics, performance tracking, and product improvement. Such data will never personally identify you or your customers.
jobRoutr handles personal information in accordance with its Privacy Policy. By using the Services, you consent to our collection and use of information as described there.
Payment Processor Fees. The Services integrate with third-party payment processors such as Stripe to enable your business to accept online payments. When your customers pay invoices online, the payment processor (e.g., Stripe) will apply transaction-level fees (e.g., for card processing or ACH) and deduct those fees from the amounts processed. jobRoutr does not set, control, or receive those payment processor fees.
jobRoutr Payment Handling Fee. jobRoutr charges a flat payment handling fee (e.g., a per-payment fee) when you use the Services to accept customer payments online. The amount and structure of the payment handling fee will be posted on the jobRoutr dashboard, pricing page, or in your account settings, and may be updated from time to time with notice. You authorize jobRoutr to collect such payment handling fees and to charge them as part of your use of the payment functionality.
Responsibility for Charges. You are responsible for all payment processor fees and jobRoutr payment handling fees associated with online payments. You agree that jobRoutr is not responsible for fees charged by third-party payment processors, including but not limited to Stripe, and that any disputes regarding such third-party fees must be resolved with the applicable payment processor.
Refunds and Chargebacks. Refunds initiated through jobRoutr or a connected payment processor do not guarantee a refund of payment processor fees. Chargebacks or disputes may result in additional fees charged by the payment processor. jobRoutr is not responsible for payment processor refund policy or chargeback fees.
By using the payment processing services, you agree to the Stripe Services Addendum and the Stripe Connect Agreement.
If you submit feedback, suggestions, or ideas about the Services (“Feedback”), you grant jobRoutr a perpetual, irrevocable, royalty-free, worldwide license to use and incorporate that Feedback without obligation or compensation to you.
The Services may integrate with third-party systems such as QuickBooks, Stripe, Google, or others. Your use of those services is governed by their respective terms and privacy policies. jobRoutr is not responsible for the content, functionality, or availability of third-party products and services.
You may cancel your account at any time through your account settings. We may suspend or terminate your access immediately if you breach this Agreement, fail to pay required fees, engage in unlawful or fraudulent activity, or interfere with other users or system integrity. Upon termination, your license ends immediately. You may request export of Your Data within 30 days of termination, after which it may be deleted or anonymized.
All intellectual property rights in the Services, including software, trademarks, logos, graphics, and content, belong exclusively to Blue Circuit LLC or its licensors. You may not use jobRoutr trademarks or branding without prior written consent.
You agree to indemnify and hold harmless jobRoutr, its officers, employees, affiliates, and agents from and against any claims, damages, liabilities, costs, or expenses (including attorneys’ fees) arising from your use or misuse of the Services, your breach of this Agreement, or any violation of law or third-party rights.
The Services are provided “as is” and “as available”, without warranties of any kind. jobRoutr disclaims all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, secure, or free from data loss. You are solely responsible for backing up Your Data.
To the maximum extent permitted by law, jobRoutr shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including loss of profits, revenue, or data. jobRoutr’s total cumulative liability for any claim shall not exceed the amount paid by you in the 12 months preceding the event giving rise to the claim. Some jurisdictions do not allow limitation of liability for certain damages; in such cases, jobRoutr’s liability shall be limited to the minimum extent permitted by law.
Any dispute, claim, or controversy arising out of or related to this Agreement or your use of the Services shall be resolved by binding arbitration conducted under the rules of the American Arbitration Association (AAA). You and jobRoutr waive any right to participate in class actions or consolidated proceedings. The arbitration shall take place in Morris County, New Jersey, unless both parties agree otherwise. You may pursue individual claims in small claims court if they qualify.
You agree to comply with all applicable laws, export control regulations, and data privacy requirements. You represent that you are not subject to any U.S. government sanctions or located in a restricted country.
jobRoutr shall not be liable for any delay or failure to perform resulting from causes beyond its reasonable control, including but not limited to natural disasters, labor disputes, internet outages, power failures, or governmental actions.
This Agreement is governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law principles. Any non-arbitrated disputes shall be brought exclusively in state or federal courts located in Morris County, New Jersey.
If any provision of this Agreement is found to be invalid or unenforceable, that provision shall be modified or severed to the minimum extent necessary, and the remainder shall continue in full force and effect.
This Agreement constitutes the entire agreement between you and jobRoutr regarding the Services, superseding all prior agreements, proposals, or understandings, whether written or oral.
